As the purchaser of the goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the goods are being imported.

  10. Termination & Cancellation

    2. Either ASA Market or you may terminate your account. If ASA Market terminates your account, you may be notified by email.
    3. If ASA Market terminates your account, any current or pending purchases on your account will be cancelled and will not be dispatched.
    4. ASA Market reserves the right to cancel purchases, for any reason prior to processing payment and dispatch.
    5. If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.
    6. If you terminate your account any non-dispatched purchases will be cancelled and you will be refunded any monies paid in relation to those purchases.
  11. Goods, Pricing & Availability
    1. Whilst every effort has been made to ensure that all graphical representations and descriptions of goods available from ASA Market correspond to the actual goods, ASA Market is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct goods, not different goods altogether. Please refer to Clause 13.1 for incorrect goods.
    2. All pricing information on the website is correct at the time of going online, however prices at the time of ordering are guide prices. ASA Market reserves the right to change prices and alter or remove any special offers from time to time and as necessary. All pricing information is reviewed and updated every two months. Our site contains a large number of goods and it is always possible that, despite our best efforts, some of the goods listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product to you.
    3. Any typographical, clerical, or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the seller shall be subject to correction without any liability on the part of the seller.
    4. No statement, description, warranty condition or recommendation contained in the website, price list, advertisement, communication or made verbally by any of the agents or employees of the seller shall be construed to enlarge, vary or override in any way thereof any of these conditions.
    5. Where appropriate, you may be required to select the appropriate and required features like size, model, colour etc of the goods that you are purchasing.
    6. ASA Market does not warrant that such goods will be available. Stock indications are not provided on the website.
    7. In the event that prices are changed during the period between an order being placed for goods and ASA Market processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price. We are under no obligation to provide the product to you at the incorrect (lower) price. The company reserves the right to cancel any orders placed at that price and return in full any payment received.

  12. Delivery
    1. Delivery will be made to the address specified by the customer when completing the online order form. All goods must be signed for by an adult aged 18 years or over.
    2. The costs of delivery will be as displayed to you on our website, our delivery policy can be found at our website’s delivery policy.
    3. ASA Market delivery and collection times are subject to availability.
    4. ASA Market shall use their reasonable endeavours to meet any date agreed for delivery. You have legal rights if we deliver any goods late. If we miss the delivery deadline for any goods then you may treat the contract at an end immediately if any of the following apply:
      1. we have refused to deliver the goods;
      2. delivery within the delivery deadline was essential (taking into account all the relevant circumstances); (or)
      3. you told us before we accepted your order that, delivery within the delivery deadline was essential.

      If you do choose to treat the contract as at an end for late delivery, you can cancel your order for any of the goods or reject goods that have been delivered.

    5. If there is no one to receive the grocery delivery at the specified address at the time of your scheduled delivery, we reserve the right to return your order to our store and to charge a delivery charge for re-delivery.
    6. If ASA Market receives no communication from you, within 24 hours of delivery, regarding any problems with the goods, you are deemed to have accepted and received the goods.
  13. Returns and Cancellations Policy
    1. ASA Market aims to always provide high quality goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions.
    2. If you receive goods which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us within 24 hours to arrange collection and return.
    3. ASA Market is not responsible for paying shipment costs for postal deliveries. You will be given the option to have the goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the goods. Refunds and replacements will be issued upon our receipt of the returned goods.
    4. The return process of the product can be restricted depending on the nature and category of the product, as outlined in our cancellation policy and our terms & conditions. The following items are excluded from our returns policy: Vegetable, Beauty Products, Food Products. These products can only be returned in accordance with your legal rights.
    5. Refunds will only be given in accordance with your legal rights on the above products. If your product is faulty, damaged or unfit for purpose, please contact us immediately. Please note you will be asked to provide photographic evidence of any damaged goods.
    6. You may return other unopened goods within 7-days of receipt and, subject to inspection and acceptance, we will refund or provide replacement(s) as applicable.
    7. Refunds will only be made via the credit/debit card used for the original transaction. Refunds will have post and packing charges deducted. Where an order qualified for free post and packing, we will deduct our post and packing costs from the refund. We reserve the right to deduct any other charges incurred by us such as credit card transaction fees, picking/packing costs, restocking costs, packaging material and return postage fees.
    8. To request a refund or replacement please contact us first by email or telephone. We will require you to return the goods, at your cost, to us for inspection asamarket.com will not be liable for goods that are lost or damaged in transit and recommend that you obtain proof of posting.
    9. Any uncollected packages that are returned to us, which included fresh fruit and/or vegetables, will require inspection before any refund can be offered. Other products which may be stained or damaged by the fruit and/or vegetables will be omitted from the refund.
    10. Any goods dispatched by us in error remain the property of asamarket.com. If you receive any goods by mistake, that weren’t ordered, please contact us within 7-days to arrange for us to collect them.
    11. If any perishable goods you have purchased have faults when they are delivered to you, you should contact ASA Market within 12 hours to arrange collection and return. Goods must be returned in their original condition with all packaging. Upon receipt of the returned goods, the price of the goods, as paid by you, will be refunded to you through the payment method used by you when purchasing the goods. Under the Consumer Rights Act 2015, perishable goods are not entitled to the statutory 30-day right to reject. The time limit of such goods is limited in instances where the goods are perishable and is therefore determined by how long it is reasonable to have expected the goods to last.
    12. ASA Market reserves the right to exercise discretion with respect to any returns under these Terms and Conditions. Factors which may be considered in the exercise of this discretion include, but are not limited to:
      1. Any use or enjoyment that you may have already had out of the goods;
      2. Any characteristics of the goods which may cause them to deteriorate or expire rapidly, as stipulated above;
      3. The fact that the goods consist of audio or video recordings or computer software and that these have been unsealed by the consumer.
      4. Any discounts that may have formed part of the purchase price of the goods to reflect any lack of quality made known to the customer at the time of purchase.
      5. Such discretion to be exercised only within the confines of the law.

  18. Limitation of Liability
    1. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
    2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractor; for fraud or fraudulent misrepresentation; for breach of your legal rights, including the right to receive products which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; supplied with reasonable skill and care and, where installed by us, correctly installed; and for defective products under the Consumer Rights Act 2015.
    3. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If our delivery of the products is delayed by an event outside of our control, then we will contact you as soon as possible to let you know and we will take reasonable steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but have not yet received.
      1. Events Outside Our Control
        We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (Force Majeure Event).
      2. A Force Majeure Event
        Includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

        1. Strikes, lock-outs or other industrial action.
        2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
        3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster.
        4. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
        5. Impossibility of the use of public or private telecommunications networks.
        6. The acts, decrees, legislation, regulations or restrictions of any government.
      3. Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
    5. Insofar as is permitted by law, our only liability to you under these Terms and Conditions will be, at our sole discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received by you in a damaged or defective state or to refund to you any sums actually paid by you for the goods in question. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us and will have no liability to you for any failure or delay in delivering goods or any damage or defect in goods delivered which is caused by any event or circumstance which is beyond our reasonable control. Nothing in this clause affects your statutory rights as a consumer.
    6. Whilst every effort has been made to ensure that these Terms and Conditions adhere strictly with the relevant provisions of the Consumer Rights Act 2015, in the event that any of these Terms are found to be unlawful, invalid or otherwise unenforceable, that Term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This Term shall apply only within jurisdictions where a particular Term is illegal.
  19. No Waiver
    1. In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
  20. Notices
    1. All notices / communications shall be given to us either by post to our premises (see address above) or by email to info@asamarket.com. Such notice will be deemed received on the day of sending if the email is sent on a business day and on the next business day if the email is sent on a weekend or public holiday.
  21. Communications & Complaints
    1. We will attempt to respond to all queries within 2-4 business days
    2. Applicable laws require that some of the information or communications we send to you should be in “writing”. When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other.
    3. Ideally, we aim to resolve any complaints you may have within a timescale of fourteen working days. If this is not possible, we will inform you and will complete the investigation within 28 days.
  22. Consumer Rights
    1. Please note that ASA Market is compliant with the Consumer Rights Act 2015, as referenced to in clause 13.4.1. However, in the sale of perishable goods, the 14-day cooling off period with regards to cancellation of orders is not applicable. So, customers wishing to cancel an order can do so until the goods have not yet been dispatched. After goods have been dispatched from the warehouse, ASA Market will not be able to cancel the order unless the goods are faulty.
  23. Law & Jurisdiction
    1. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site. Although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
  24. Severability
    1. If any of these Terms and Conditions or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such Term, Condition or provision will to that extent be severed from the remaining Terms, Conditions and provisions which will continue to be valid to the fullest extent permitted by law.
    2. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
